Welcome to CloudPath Hosting. These Terms of Service (“Terms” or “Agreement”) govern access to and use of the website and services provided by CloudPath Hosting (“we”, “us”, “our”, “the Service”). By using our website and services, you agree to these Terms. If you do not agree, do not use our Services.
- Domain Registration & Management
Domain Availability: Registration and availability of domain names is not guaranteed until confirmation of registration in your name has been provided by us.
Third-Party Conditions: The registration and use of domain names is subject to the terms imposed by applicable naming authorities, including but not limited to:
ICANN for .com/.net/.org domains
Nominet for .uk domains
auDA for .com.au and .au domains. You are responsible for ensuring compliance with all relevant terms of the applicable registry for your chosen domain extension, including eligibility requirements for Australian domains as set by auDA.
No Liability for Registration Refusals/Disputes: We are not liable for any decision by a naming authority to refuse or revoke registration, nor for any dispute related to the use of a domain name. Administrative fees are non-refundable in the event of a declined or revoked registration.
Domain Releases: Transfer of domain names to other providers is contingent upon full payment of all relevant fees.
- Payment, Billing, and Suspensions
Service Fees: All charges are as published and payable in advance.
Non-Payment: Non-payment by the due date may result in immediate suspension or termination of service. Backups of suspended cPanel services are retained for 30 days, after which all data may be deleted without further notice.
Account Termination: We reserve the right to terminate services for insolvency, non-payment, or breach of these Terms. Upon termination, website access may be blocked and all associated data may be deleted.
- Refund Policy
Refund requests will be considered if made within 30 days of purchase, except for:
Domain registrations, SSL certificates, or third-party services.
VPS or Dedicated Servers, setup fees, or services terminated for policy violations.
Renewals and promotional purchases after the guarantee period.
Excess funds, which are credited to your account only.
Initiating a payment dispute or chargeback will result in immediate cancellation and data deletion for all associated services.
Web design setup fees are non-refundable once design and development have commenced.
- Service Delivery & Migration
Service Provisioning: Orders are processed electronically and sent via email after successful payment. Any delays will be communicated.
Migration: Free migration is provided for the primary domain of your cPanel account only.
Support: 24/7 support is available via tickets; chat support may have limited availability outside of standard hours.
- General Use & Restrictions
User Conduct: All authorized users must comply with these Terms. You are responsible for all use under your account.
Prohibited Uses: The following may result in suspension or termination:
Illegal activities, spam, malware, unauthorized access, resource abuse, or prohibited content.
Usage as a backup or file storage repository outside policy limits.
Resource Limits: Users may not utilize >10% of system resources for more than 60 seconds, run unauthorized daemons, participate in file sharing, or run cron jobs at intervals less than 15 minutes.
Backups: Customer backups stored on our servers must be removed within 14 days and stored locally.
- Backups & Disaster Recovery
Backups: We provide free weekly backups. Daily backups are available as a premium add-on.
VPS: VPS backup is the full responsibility of the user.
Disaster Recovery: In an event of disaster, we aim to restore services within 1–3 days from disaster recovery backups.
- Suspension, Termination, and Refunds
Any breach of these Terms or failure to rectify a notified breach may result in suspension or termination. We will provide three (3) days’ advanced notice where possible. No credits are available during suspension. - Affiliates and Promotion
Affiliates must use officially provided links and may not use spam or self-referrals.
Violations result in loss of affiliate earnings and removal from the program.
- Reseller Provisions
Reseller accounts may not be used to provide free accounts. Complimentary cPanel migration applies only to primary accounts transferring to CloudPath Hosting. - Discount Vouchers
Vouchers are limited to one per customer/transaction and must be fully redeemed at time of purchase, only for eligible products. - Disputes & Arbitration
Any unresolved disputes will be subject to binding arbitration in accordance with the governing law specified below. - Governing Law
This Agreement is governed under the laws of the State of Wyoming, USA. - Service Amendments

15.1 Service Description
CloudPath Hosting (“Provider”) offers a Web Design Service as an optional add-on to eligible hosting accounts. The Service encompasses the design, development, and maintenance of a standard business or e-commerce website, subject to these conditions.
15.2 Fees and Payment
A one-time setup fee and monthly ongoing maintenance fee apply, payable in advance. The setup fee is non-refundable once work has commenced.
15.3 Scope and Limitations
The Service covers the development and deployment of a basic static or standard e-commerce website with integration to Provider’s infrastructure.
Advanced custom development, application integrations, or features outside the standard offering require a separate written agreement and may incur additional costs.
Free migration is limited to the primary domain and does not extend to additional domains.
15.4 Engagement and Delivery
Service activation requires full completion of all necessary project forms and provision of requested information.
Expected delivery is three (3) to twenty-one (21) business days after all required information and payment are received; delayed responses from the Client may extend timelines.
15.5 Maintenance and Updates
Maintenance includes technical updates, bug fixes, minor content or feature adjustments (up to three per month). Excess requests or advanced work will be agreed separately and billed accordingly.
15.6 Cancellation and Termination
The Client may cancel the Service at any time by written notice. All fees for the current billing period are non-refundable post-cancellation.
Full cPanel and website access is retained until the service is terminated. Clients are responsible for backing up their own data prior to termination.
15.7 Client Responsibilities
The Client must provide accurate, lawful content and information, and comply with all applicable requirements under these Terms and governing law.
The Client remains responsible for maintaining independent backups of their website data.
15.8 Limitation of Liability
The Provider is not liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to data loss or business interruption, arising from the Web Design Service.
The Provider is not responsible for issues deriving from subsequent third-party modification or software updates after delivery.
15.9 Incorporation by Reference
These Web Design Service Terms are incorporated into, and form part of, the general Terms of Service of CloudPath Hosting.
